General terms of the rental contract

General terms of the rental contract

Article 1
The purpose of these general rental contract terms is to define the conditions of the rental of the accommodation by the manager to the tenant for the duration and under the conditions specified herein.

Article 2 – Duration of stay
The tenant signing this contract, concluded for a fixed term, may under no circumstances claim any right to remain on the premises after the stay.

Article 3 – Reservations
The availability of the rental will be confirmed by the manager. The number of people occupying the accommodation, as well as their identity, must be specified when making the reservation request. The use of the establishment will be limited to these individuals and must not exceed this number for insurance and safety reasons.

Article 4 – Conclusion of the contract
The reservation becomes effective as soon as:

  • The adult tenant will have sent the full rental payment to the manager.
  • Receipt of the signed contract accepting the general terms of the rental agreement as well as acceptance of the establishment's internal regulations.
  • Specify the identity of each person present at the rental (Name, First name, Age, Address).
  • The rental agreement concluded between the parties to this contract may under no circumstances benefit third parties, whether natural or legal persons, unless expressly agreed in writing by the manager. Any violation of this clause may result in the immediate termination of the rental at the tenant’s expense, with the rental fee remaining definitively acquired by the manager.

The rental price includes all charges (water charges, WiFi, and provision of household linen). Regarding energy consumption (electricity/heating), in an effort to save energy and respect the environment, expenses are included in the price based on a usage of 6 kWh per day per person (equivalent to the average daily consumption of one person in France in 2024). Any excess consumption must be paid to the manager.

No dispute regarding the price of the stay will be considered after the contract is signed. It is up to the tenant to assess whether the price is suitable before signing. Only the tourist tax for each overnight stay for persons over 18 years old remains payable on-site.

Article 5 – No right of withdrawal
For reservations made by mail, telephone, or online, the tenant does not benefit from a withdrawal period, in accordance with Article L.121-20-4 of the Consumer Code, which applies in particular to accommodation services provided on a specific date or at a specified frequency.

Article 6 – Cancellation by the tenant
Any cancellation must be notified by email to the manager at the following address: direction@maisonchevalier.org.

  1. Cancellation before arrival on the premises: a) If the cancellation occurs less than 30 days before the scheduled check-in date, the manager may retain the remaining balance of the total stay. b) If the cancellation occurs more than 30 days before the scheduled check-in date, the manager may retain 20% of the total stay amount. If the tenant does not arrive within 24 hours of the scheduled check-in date indicated in the contract, the contract becomes void, and the manager may reallocate the accommodation. The payment also remains retained by the manager.
  2. Si le séjour est écourté, le prix de la location reste acquis au gestionnaire. Il ne sera procédé à aucun remboursement.

Article 6 – Cancellation by the tenant
The manager refunds the tenant the full amount paid.

Article 8 – Arrival / Departure
The tenant must arrive on the specified day and at the time mentioned in the rental contract. They must also vacate the accommodation on the specified day and at the time indicated in this contract. As a reminder, check-ins are from 6:00 PM and check-outs before 11:00 AM. However, there is the possibility of advancing the check-in time or delaying the check-out time by up to 2 hours before or after, for an additional fee of €15 per hour.

Article 9 – Inventory
The accommodation is rented furnished and equipped as described in the attached inventory. The cleaning of the premises is the tenant’s responsibility during the rental period, while the end-of-stay cleaning is handled by the manager.

All installations are in working order, and any complaint regarding the inventory or description made more than 24 hours after taking possession of the premises will not be considered. Failing that, the premises and equipment are deemed to be in compliance and in good condition. Repairs required due to negligence or poor maintenance during the rental period will be the responsibility of the tenant or their family. No replacement of objects, except identical ones, will be accepted at the tenant’s initiative.

Within 48 hours (business days) following the end of the rental, the manager will conduct the check-out inspection and notify the tenant by email, if applicable, of any damages observed. The cost of these damages will be deducted from the security deposit.

Article 10 – Security deposit or bond
At the time of booking, a security deposit of €300 by bank transfer is required by the manager. In case of non-payment, entry to the premises will not be allowed. It will be refunded by bank transfer within 7 days after the rental ends, provided no damage is found within 48 hours of the tenant's departure. Otherwise, the tenant will be responsible, in addition to the rental fees, for any damage caused within the establishment, as well as the cost of replacing any lost, destroyed, or damaged items, and those whose wear exceeds normal use for the rental period. This includes the cost of cleaning stained duvets, painted walls, ceilings, windows, curtains, and bedding. The tenant is liable for any damage caused either intentionally or through negligence by themselves or their companions.

Article 11 – Use of the premises
The tenant must ensure the peaceful nature of the rental and use it in accordance with its intended purpose. Children are under the sole and full responsibility of their parents or accompanying persons.

Article 12 – Capacity
This contract is established for a maximum capacity of people as defined at the time of booking, which may not be exceeded under any circumstances. The rented premises must not, under any circumstances, be occupied by more people than indicated at the time of booking. In case of non-compliance with this clause, a compensation of €150 per unregistered person will be paid to the manager, leading to the immediate cancellation of the booking without any refund. Any modification or termination of the contract will be considered at the client's initiative.

Article 13 – Animals
For hygiene reasons and out of respect for all guests, pets or other animals are not allowed in the accommodation. In case of non-compliance with this clause by the tenant, the manager may refuse the stay, and a penalty of €150 per animal must be paid by the tenant. In this case, no refund will be issued.

Article 14 – Insurance
The tenant is responsible for all damages caused by their actions. They are required to be insured through a vacation rental insurance policy for these various risks. The lack of insurance, in the event of an incident, will result in damages and compensation. The manager undertakes to insure the accommodation against rental risks. The tenant is obliged to report any incident occurring in the accommodation, its annexes, or accessories within 24 hours.

Article 15 – Tobacco
Smoking is strictly prohibited in the accommodations and common areas. In case of non-compliance with this clause, a penalty of €100 per incident and per damaged unit will be imposed by the manager.
